1. Introduction

Welcome to Janded (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Janded website, mobile applications, and services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Eligibility

You must be at least 13 years old to use our Services. By using our Services, you represent and warrant that:

  • You have the legal capacity to enter into these Terms
  • You will comply with these Terms and all applicable laws

All content on Janded, including videos, images, text, graphics, logos, and software, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

User Content

By submitting content to our Services, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and promoting our Services. You represent that you have all necessary rights to grant this license.

5. Platform Protection & User Safety

To ensure a safe environment for all users and partners, you agree not to engage in any of the following prohibited activities:

  • Violating any applicable laws, regulations, or third-party rights
  • Infringing upon Janded's or its partners' intellectual property rights
  • Uploading malicious software, viruses, or attempting to compromise platform security
  • Attempting to reverse engineer, scrape, or data mine our content without explicit permission
  • Harassing, abusing, threatening, or harming other users or business partners
  • Submitting false, defamatory, or misleading reviews or content about businesses
  • Impersonating any person or entity, including Janded staff or partner businesses

Janded reserves the right to immediately suspend or terminate accounts, remove content, and take legal action against users who violate these safety frameworks, to protect the platform and our community.

6. Business Protection & Partnerships

For Business Partners

Businesses featured on Janded enter into separate partnership agreements with us. We are committed to protecting the brand integrity and operational security of our partners. Janded actively monitors for and removes malicious, fake, or defamatory reviews or interactions targeting our partners.

For Users

The inclusion of a business on our platform is based on curatorial standards, but Janded is not liable for the individual services, products, or experiences provided by third-party businesses. Any transactions or disputes are strictly between you and the business. However, we maintain a reporting framework to investigate any partner that violates our community safety standards.

7. Disclaimer of Warranties

Our Services are provided “as is” and “as available” without any warranties, express or implied. We do not warrant that our Services will be uninterrupted, secure, or error-free. Your use of our Services is at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, Janded and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Services.

9. Indemnification

You agree to indemnify and hold harmless Janded and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of our Services or violation of these Terms.

10. Termination

We may terminate or suspend your access to our Services at any time, with or without cause, with or without notice. Upon termination, your right to use our Services will immediately cease. Provisions that by their nature should survive termination shall survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Cape Verde, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Cape Verde.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on our website and updating the “Last updated” date. Your continued use of our Services after such changes constitutes acceptance of the new Terms.
